Custody

Custody is the legal right and responsibility to care for a child. It includes making decisions about the child’s upbringing, health, and welfare. For example, parents have custody to make decisions about their child’s schooling.

In Germany, parents usually have joint custody unless there are specific reasons against it (§ 1626 BGB). In cases of separation or divorce, custody can become a contentious issue. A common mistake is assuming that one parent automatically has sole custody when living apart. It’s important to apply for custody in a timely manner if conflicts arise.
