Subtenant

A subtenant is someone who takes over a rental unit from a tenant who has moved out. For example, if you decide to leave your apartment and someone else wants to move in, that person is considered a subtenant.

For residents in Germany and Austria, it’s important to inform the landlord about a subtenant in a timely manner. You often need to propose a subtenant to fulfill your rental obligations before your lease ends. Make sure the subtenant has the landlord’s approval, and be aware of deadlines according to § 564 BGB or § 1116 ABGB.
